Terms & Conditions
Concerts for Babies is a project developed by MUSICALMENTE UNIPESSOAL LDA, which detains and operates this website.
The purchase of products at the Concerts for Babies Online Shop is subject to the following terms and conditions:

1. Object
1.1. The present General Conditions in force are intended, with the order form and the other elements referred to, to regulate the terms and conditions that regulate the providence of the service in the Online Shop of Concerts for Babies.

1.2. The purchase of any product in the Online Shop of Concerts for Babies implies acceptance of these General Online Sales Conditions.

2. Information about products, prices and contents
2.1. Musicalmente is reserved to the right to modify, without advance notice and at any moment, the information and commercial offer regarding: products, prices, promotions, commercial conditions and services.
2.2. The articles for sale at the online shop are subject to existing stock and the orders will be processed by arrival order. In the event of a temporary or permanent out of stock, the customer will be informed as soon as possible and an alternative of products with similar characteristics will be suggested.
2.3. The Concerts for Babies at Home are concerts broadcasted live on this website which on can access by purchasing a ticket until 9.00 am of the day of the concert. After the broadcast, recording of the concert will be available for the one who bought the its ticket.
2.4. The selling prices of the items and services published on our online shop include VAT at the legal rate practiced in Portugal, that is, 6% for tickets to access the broadcasted shows, 13% for musical instruments and 23% for other products and services, applicable to purchases made in Portugal and abroad.

3. Order and payment
3.1. Orders will only be sent after stock and payment confirmation and will be processed by arrival order.

3.2. If an order can not be satisfied in part or entirely, the customer will be contacted immediately by MUSICALMENTE.
3.3. The Online Shop of Concerts for Babies offers the following payment methods to its consumer: Bank Transfer, PayPal, MB Way (only in Portugal) and ATM (payment for services/purchases).
3.4. The payments are received in euros ( € ), regardless of the currency in which the transaction is made. The conversion rates for payments made in other currencies must be supported by the customer.

4. Shipping costs
4.1. The User will be able to choose one of the following methods, having to responsibility to choose the one that best suits his/hers shipping address. To the methods apply the following shipping costs:
4.1.1. Portugal
a) Regular Mail – 3,00€
b) Registered Mail – 4,90€

4.1.2. International
a) Regular Mail – 5,40€

4.2. The shipping costs are indicated in the shopping basket before final order validation.
4.3. Dans l’option de retrait gratuit au siège, la date et l’heure de retrait seront convenues avec le client une fois l’achat terminé. L’adresse de l’enquête est Rua da Saudade, nº 20, 2410-241, Leiria.

5. Delivery
5.1. Orders will only be sent after stock and payment confirmation as soon as possible.

5.2. The delivery of orders will be made to the address indicated by the customer and according to the delivery schedule of Portugal’s Post Office (CTT). Order deliveries can be made outside of Continental Portugal.

5.3.  All the products must be verified at the delivery moment. If the customer verifies that the order is damaged, he/she must return it immediately to the Post Office, indicating to MUSICALMENTE the motive of returning by e-mail at [email protected].

5.4. If after the delivery the customer finds that any item is not in compliance, he/she is asked to immediately contact MUSICALMENTE through the e-email [email protected] indicating the order number or the number of the document that followed the order, attaching images of the packing as he received it and all the items, so that the situation can be solved as soon as possible.

6. Returns and Complaints
6.1. MUSICALMENTE allows products to be returned within 14 days under the terms of Decree-Law nº 143/2001 and Decree-Law 82/2008 of 20/5. However, upon return, the product must remain in perfect conditions.
MUSICALMENTE will not accept the return of the product after it has been modified or altered.

6.2  To request an exchange or return, the customer is asked to contact MUSICALMENTE through the e-mail [email protected] indicating the invoice number.

6.3. The return of the defective products and wrong shipments is of the responsibility of MUSICALMENTE, as well the shipping and collection costs when the customer reports this situation within 14 (fourteen) days from the date of receipt of the product. Once the items are received at our facilities and after validating their status in accordance, the value will be credited through the method agreed between both parties.

6.4. The refund is made up to 14 days after receiving the free will resolution and receiving the return of the item(s).

6.5. MUSICALMENTE is not responsible for the deficiencies resulting from the incorrect use, negligence and bad storage conditions by the Customer.

6.6. The User can submit any contractual conflicts to the arbitration and mediation mechanisms that are or may be legally constituted, as well as complain to the MUSICALMENTE of acts and omissions that violate the legal provisions applicable to the acquisitions of goods.

6.7. The complaint must be submitted within a maximum period of 30 (thirty) days, counted from the knowledge of the facts by the User, being registered in the information systems of MUSICALMENTE that must decide the complaint and notify the interested party within a maximum period of 30 (thirty) days from the date of receipt.

8. Declaration of Responsibility
MUSICALMENTE expressly declares and warrants that:
a) It will properly handle the Personal Data it collects from its Customers in the context of providing the Online Shop Service, which will be subject to a lawful and confidential, loyal and transparent treatment, and in a way that guarantees their security, namely obliging them whether to protect such Personal Data from accidental or unlawful destruction, accidental loss, alteration, dissemination or unauthorized access;

b) It is in a position to ensure all the appropriate technical and organizational measures so that the processing of Personal Data satisfies the requirements of the current Personal Data Protection Law, approved by Law nº 67/98, of October 26th and by the Regulation (EU) 2016/679 of the European Parliament and the Council of 27.04.2016, (“GDPR”), which entered into force on May 25th, 2018.

c) The Personal Data is only intended for the execution of orders made on Online Shop, being only those necessary, suitable, relevant and limited to that purpose being collected;

d) It will keep Personal Data accurate and up to date;

f) It will not use the Personal Data which has access for any other purpose than that provided for in these Terms and Conditions;

g) At the request of the Customer, it will destroy the referred Personal Data on an immediately and efficient way.
